Terms of Service

1. Acceptance of these Terms

These Terms of Service ("Terms") govern your access to and use of the gene-works.fi website and registration platform (the "Service"), operated by Gene-Works Oy (Business ID 2198820-6), Finland. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. What the Service is — and is not

• The Service allows individuals to register their interest in gathering wild berries and to manage that registration online.
• Registration, joining a waiting list, or any communication through the Service does not create an employment relationship and does not by itself form a binding agreement to participate.
• The specific terms of any participation — including any commercial terms — are agreed separately and individually, are provided to you directly, and are not part of these Terms or of this website.
• Pickers act as independent gatherers under the Finnish natural-products gathering law (487/2021) and are not employees of Gene-Works Oy.
• Gene-Works does not arrange visas, residence permits or work permits. The Service is intended only for persons who already hold their own legal right to stay in Finland and to gather natural products.

3. Eligibility

You must be at least 18 years old, have the legal right to stay in Finland and gather natural products, and provide information that is true, accurate, current and complete.

4. Accounts

You are responsible for keeping your login credentials secure and for all activity under your account. Use one account per person and notify us of any unauthorised use. We may refuse, suspend or terminate any account at our sole discretion, including for inaccurate information or misuse.

5. Your information and documents

You confirm that all information and documents you submit are true, valid and your own. Submitting false, forged or another person's documents is strictly prohibited and may be reported to the authorities. We may verify, request changes to, or reject any submission. You are solely responsible for the accuracy of the data you provide, and we are not liable for any consequence arising from incorrect data submitted by you.

6. No guarantee of a place

Registering does not guarantee acceptance, a place, a particular camp, a start date, or any other outcome. Places are limited and offered entirely at our discretion. We may pause, limit or close registrations at any time.

7. Acceptable use

You agree not to: use the Service unlawfully; provide false information or impersonate others; upload malware; attempt to access, probe, scrape, disrupt or reverse-engineer the Service or its security; or use other people's personal data without right.

8. Intellectual property

The Service, its content, design and trademarks are owned by Gene-Works Oy. You receive a limited, personal, non-transferable right to use the Service for your own registration. You may not copy, reproduce or reuse any part without our written permission.

9. Privacy

We process personal data as described in our Privacy Policy (gene-works.fi/privacy), which forms part of these Terms.

10. Third-party services

The Service relies on third-party providers (e.g., hosting, database and email services). We are not responsible for the availability, content or practices of third-party services or external links.

11. Availability and changes to the Service

The Service is provided "as is" and "as available". We may modify, suspend or discontinue any part of the Service at any time, without notice and without liability. We do not warrant that the Service will be uninterrupted, secure or error-free.

12. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Service and all information on it are provided without warranties of any kind, whether express or implied, including fitness for a particular purpose and accuracy.

13. Limitation of liability

To the maximum extent permitted by applicable law, Gene-Works Oy shall not be liable for any indirect, incidental, special or consequential damages, loss of data, or loss of profits, arising from or related to your use of (or inability to use) the Service or your reliance on any information provided through it. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory law, including mandatory consumer rights.

14. Indemnity

To the extent permitted by law, you agree to hold Gene-Works Oy harmless from any claims, losses or costs arising from your breach of these Terms or from any unlawful, false or inaccurate information you submit.

15. Suspension and termination

We may suspend or terminate your access at our discretion, in particular for breach of these Terms. You may stop using the Service at any time and request deletion of your account, subject to data we must retain by law.

16. Changes to these Terms

We may update these Terms from time to time. The current version and its "last updated" date are always available at gene-works.fi/terms. Continued use of the Service after changes means you accept the updated Terms.

17. Governing law and disputes

These Terms are governed by the laws of Finland. Disputes shall be resolved by the competent courts of Finland. A consumer may also bring proceedings in their country of residence and may use the Finnish Consumer Disputes Board (kuluttajariitalautakunta) or the EU Online Dispute Resolution platform.

18. Miscellaneous

If any provision is held invalid, the remaining provisions stay in force. Our failure to enforce any right is not a waiver of it.
